The 25-page lawsuit was filed less than a month after the National Highway Traffic Safety Administration (NHTSA) issued a recall of the car seats, including those bearing model numbers CC321GYU, CC321GYUD, CC321GYY, CC321GYYD, CC321HAO and CC321HAR. According to the class action suit, the headrests of the recalled car seats can become detached, allowing children to pick off, eat and potentially choke on pieces of foam.
The case claims the manufacturer, despite being aware of the safety risks associated with the car seats, failed to warn consumers that the products were “dangerously unsafe” for children. Nowhere in marketing materials or on the packaging or labeling is the potential choking hazard disclosed to shoppers, the complaint alleges.

Per the NHTSA’s recall announcement, Dorel will mail a replacement headrest pad assembly kit to affected consumers who register their car seat. However, the company has not offered to refund customers or provide a replacement with a comparable product, the filing says.
Reasonable consumers do not expect the car seats, which are touted as safe and reliable, to pose a choking hazard to children, the Grow & Go Sprint car seat lawsuit charges.
The safety risks presented by the products render them “worthless and dangerous” and unfit for their intended purpose, the case contends.
The class action lawsuit looks to represent all individuals in the United States who purchased or used a Safety 1st Grow & Go Sprint car seat with a model number listed on this page at any time during the applicable statute of limitations period.
