Grubhub has agreed to a $24,750,000 settlement to resolve a class action lawsuit that alleged the food delivery platform, in violation of California law, misclassified delivery drivers as independent contractors, not employees, to avoid paying certain necessary employment expenses.

The $24.75 million Grubhub class action settlement received preliminary approval from the court on March 13, 2026. The deal covers all individuals who entered an agreement with Grubhub to use its platform as an independent contractor to offer delivery services to customers and who used the platform to accept or complete at least one delivery in California between December 3, 2014 and March 13, 2026.
Court documents state that approximately 62,000 people are covered by the Grubhub settlement.
The court-approved website for the Grubhub independent contractor settlement can be found at GrubhubCALSettlement.com.
According to the website, Grubhub settlement class members who file a valid, timely claim form are eligible to receive a cash payout from the deal. The settlement agreement states that each class member’s payment will be calculated uniquely based on the estimated number of miles they traversed while acting as a delivery driver for the platform, as indicated by Grubhub’s records.
The agreement notes that no class member who files a valid, timely claim form will receive a payment of less than $25.
The class action settlement agreement adds that payments issued to class members will be considered non-wages, and an IRS Form 1099 will be provided to class members if required.
To file a Grubhub settlement claim form online, class members can head to this page and log in using the notice ID and PIN found on their copy of the settlement notice.
All Grubhub delivery driver settlement claim forms must be submitted by June 18, 2026.

The court will determine whether to grant final approval to the Grubhub settlement following a hearing on July 30, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The Grubhub class action lawsuit claimed that the platform classified delivery drivers as independent contractors when they should have been considered bona fide employees. As a result of the misclassification, the case said, Grubhub did not reimburse drivers for necessary expenses, such as the cost of vehicle operation, gas, parking, and phone data.
The lawsuit argued that Grubhub, due to the apparent misclassification, failed to ensure that its delivery drivers received the minimum wage after the payment of necessary work expenses, in violation of the California Labor Code, Unfair Competition Law, and the federal Fair Labor Standards Act.
