Grubhub Settlement Resolves Class Action Over False Advertising, Inaccurate Prices on CA Delivery Orders

Grubhub has agreed to settle a class action lawsuit alleging that the online ordering and delivery platform did not truthfully represent the cost of delivery fees, service fees and menu prices on delivery orders made in California.

The Grubhub class action settlement received preliminary approval from the court on January 12, 2026 and covers all individuals who ordered and paid for a food order on the Grubhub or Seamless app or website to an address in California any time between January 24, 2019 and January 12, 2026.
The court-approved website for the Grubhub delivery fees settlement can be found at GHDeliveryFeeSettlement.com.
According to the website, Grubhub settlement class members who file a valid, timely claim form are eligible to receive a one-time $10 Grubhub credit for use on the Grubhub app or website. The settlement agreement states that if the value of settlement benefits issued to all class members exceeds $5 million, the value of each credit may be subject to a pro-rated reduction.
Instructions on how to accept and redeem each class member’s Grubhub settlement credit will be issued to them via email by the settlement administrator, the site adds.
As part of the deal, Grubhub has also agreed to certain business practice changes to ensure any fees and taxes are prominently disclosed, such as adding them as separate line items. Furthermore, Grubhub will no longer advertise “free delivery” for Grubhub+ members on orders where other fees apply (but may continue to display “$0 delivery” for Grubhub+ orders).

To submit a Grubhub settlement claim form, class members can head to this page and enter the unique ID as listed on their received copy of the settlement notice.
All Grubhub delivery fees settlement claim forms must be submitted online by May 12, 2026.
Consumers who believe they may be a Grubhub settlement class member but did not receive a notice can contact the settlement administrator to confirm their identity and obtain their login information.
The court will determine whether to grant final approval to the Grubhub settlement at a hearing on April 29, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Grubhub class action lawsuit alleged that the food delivery platform misleadingly represented its delivery fees, service fees, California Drivers Benefits Fees, and menu prices on California delivery orders in violation of the state-specific Unfair Competition Law, Consumer Legal Remedies Act and False Advertising Law.
