$7.15M+ Grubhub Settlement Ends Lawsuit Over Alleged Use of Names, Logos of Unaffiliated Restaurants

Grubhub has agreed to a $7,154,586 settlement to resolve a class action lawsuit that alleged the company wrongfully listed on its delivery platform the names and logos of certain businesses without a contract affirming their consent to do so.

The Grubhub class action settlement received preliminary approval from the court on September 9, 2025 and covers all businesses whose names and logos were used on Grubhub or any other part of its platform—including AllMenus, Eat24, Seamless, Tapingo, LevelUp, OrderUp, BiteGrabber, and MenuPages—without a contract with Grubhub between January 1, 2019 and April 20, 2024.

According to the website, business representatives of Grubhub settlement class members who submit a valid, timely claim form are eligible to receive a pro-rated cash payment in an amount determined by the length of time each individual business was listed on the platforms without a contract in place. The settlement agreement outlines that businesses with valid claims will receive an initial $50 cash payment and later a separate, uniquely pro-rated payment.
Per the settlement website, payments from the Grubhub deal will be reduced on a pro rata basis, and the length of time a business appeared on one of the platforms without a contract should the total amount of initial payouts exceed the total amount of settlement funds available.
The settlement agreement adds that Grubhub class members can receive their payouts via check or electronic payment, and all checks must be cashed within 90 days of issuance before expiration.
As part of the class action settlement, Grubhub has also agreed to some permanent, injunctive business practice changes meant to prevent the company from listing non-contracted restaurants and vendors on its platform.
To submit a Grubhub settlement claim form online, business class representatives can head to this page and enter the unique class member ID and PIN listed on their copy of the settlement notice. Consumers who believe their business may be covered by this settlement but did not receive a notice should contact the settlement administrator to confirm eligibility and receive login information.
Alternatively, Grubhub class representatives can download a PDF of the claim form from the settlement website to print, fill out and return by mail to the address listed at the bottom of the document.
All Grubhub settlement claim forms must be submitted online or by mail by March 4, 2026.
The court will determine whether to grant final approval to the Grubhub settlement at a hearing on April 15, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The Grubhub class action lawsuit alleged that thousands of businesses were listed on the food delivery platform, and the platforms of a handful of its affiliates, without a contract in place. As a result, the case argued, consumers reasonably believed that the businesses had a contract or an agreement with Grubhub to do business, which supposedly hurt the businesses’ reputations and caused them to lose out on sales.
