Issue #358

False Advertising? New Lawsuits and Investigations

This week’s issue focuses on how companies market their products, including whether certain practices could be considered misleading, deceptive or even unlawful.

Indeed, lawsuits have recently been filed over “hypoallergenic” claims on a store-brand body wash and allegations that a pricey “100% agave” tequila may not be as authentic as it claims.

Also in this issue: from video games to cash advances, attorneys working with ClassAction.org have launched two new investigations—and you can find all the details below.

To wrap things up, we have the latest class action settlements you may be able to claim.

Genshin Impact Investigation: Deceptive Design?

Though it’s technically free-to-play, some Genshin Impact players may find it difficult to advance in the open-world role-playing game without spending some—or a lot—of real money. In light of this, attorneys are looking into whether the game manipulates players into spending money through dark patterns and deceptive game design. So, if you bought virtual items or currency in the game, join others taking action over on this page.

Are MoneyLion Cash Advances Predatory Loans in Disguise?

Although MoneyLion promotes Instacash as a way for users to access their earned wages early—and with no interest—attorneys believe these cash advances function more like high-interest loans and may violate certain financial laws. They’re now gathering consumers who received an Instacash advance through the personal finance app to take action and potentially recover $100s. Learn more and sign up here.

Albertsons Lawsuit Challenges “Hypoallergenic” Claims
A recently filed lawsuit is claiming that Albertsons misrepresents its “hypoallergenic” Signature Care Sensitive Skin Body Wash, given that the product contains several common allergens. The case alleges that, in particular, the body wash contains two preservatives linked to allergic contact dermatitis, which appears as a red, itchy rash. If you bought this body wash, read more on the case here.
Lawsuit Takes Issue with “100% Agave” Claims on Cincoro Tequila

With the popularity of tequila rising over the past several years in the U.S., some manufacturers have found themselves in the spotlight—and not necessarily in a good way. In the case of Cincoro tequila, a new lawsuit is alleging that certain varieties contain significant amounts of ethanol not derived from the tequilana weber blue variety of agave, the only type used in the production of authentic tequila. With some bottles reportedly retailing for as much as $1,700, you’ll want to learn more about the allegations here.
