What's Going On?
More settlements have been reached in lawsuits alleging that real estate brokerages and trade association National Association of Realtors (NAR) violated antitrust law by requiring home sellers to pay inflated commissions to buyers’ brokers and agents.
Most recently, real estate brokers Higher Tech Realty (doing business as Mark Spain Real Estate), eXp World Holdings, Weichert of North America and Atlanta Communities Real Estate Brokerage have agreed to collectively pay over $44 million to resolve the claims against them.
Other defendants—including NAR, Berkshire Hathaway, Anywhere Real Estate, RE/MAX, Keller Williams, Compass and others—have already entered into settlements, and more may decide to settle in the future. The total value of all the settlements is now over $1 billion.
Who’s Eligible for the Real Estate Settlements?
The settlements cover anyone who, between October 31, 2019 and July 22, 2025, sold a home that was listed on a multiple listing service anywhere in the United States where a commission was paid to any real estate brokerage in connection with the sale.
How Much Could I Get?
Those who file a valid claim form will be eligible to receive a share of the $44.05 million settlement fund, which will be distributed to eligible claimants after attorneys’ fees, expenses and settlement administration costs have been deducted.
Higher Tech, eXp, Weichert and Atlanta Communities have also agreed to implement practice changes and cooperate in the ongoing litigation.
How Do I File a Claim?
You can file a claim on the official settlement website. The claim form can be accessed here.
If you sold more than one home during the eligible date range (October 31, 2019 to July 22, 2025), you will need to file a separate claim for each home.
If you’ve already submitted a claim in a previous commission fee settlement, you may also file a claim for the new settlements if you are eligible.
Is the Settlement Website Legit?
Yes. It has been designated by the court as the official website for the settlements and where consumers will need to go if they want to file a claim online.
Is There a Deadline for Filing a Claim?
Yes. The deadline for filing a claim is September 20, 2025.
