Up to $4.5M JustPlay Settlement Ends Class Action Lawsuit Over Alleged Biometric Privacy Violations

An up to $4.5M settlement offers cash to Illinois residents whose biometrics may have been collected without consent on the JustPlay gaming app.

JustPlay and Gimica Games have agreed to a class action settlement of up to $4,500,000 to resolve a lawsuit that alleged the developers unlawfully collected and stored the biometric information of JustPlay mobile gaming app users, in violation of the Illinois Biometric Information Privacy Act (BIPA).

The JustPlay class action settlement received preliminary approval from the court on December 2, 2025 and covers all Illinois residents whose biometric information may have been collected, captured, possessed, used, transmitted, stored or otherwise obtained by the JustPlay mobile gaming app without prior written consent.

According to the website, JustPlay settlement class members who submit a valid, timely claim form are eligible to receive a one-time cash payment of $15 with no proof required. JustPlay class members may elect to receive their payout via electronic payment or check, which the settlement agreement says must be cashed within 90 days after issuance before expiration.
The amount each class member may receive could decrease should the total cost of all valid claims and the cost of attorneys’ fees, lead plaintiff service awards, and settlement administration exceed $4.5 million, court documents state.

As part of the settlement, JustPlay has also agreed to implement business practice changes to ensure compliance with the Illinois Biometric Information Privacy Act for a minimum of five years.
To submit a JustPlay claim form online, class members can head to this page and enter the class member ID and PIN provided in their emailed copy of the settlement notice. Alternatively, class members may download a PDF of the claim form from the settlement website to print, fill out and return by mail to the address of the settlement administrator on the first page of the document.
Consumers who believe they may be a JustPlay class member but did not receive a settlement notice can contact the settlement administrator to confirm their identity and receive their login information.
JustPlay settlement claim forms must be submitted online or by mail by March 16, 2026.
The court will determine whether to grant final approval to the JustPlay settlement at a hearing on March 31, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The JustPlay class action lawsuit alleged that the gaming app’s operators, JustPlay and Gimica, unlawfully collected and stored users’ personal biometric information, including facial scans, to verify identities without obtaining consent.
