HCF Management Class Action Settlement Wraps Up Lawsuit Over 2024 Data Breach

HCF Management has agreed to a class action settlement to wrap up a lawsuit that alleged the rehabilitative healthcare provider failed to protect employees’ and customers’ private information from a September 2024 data breach.

The HCF Management class action settlement received preliminary approval from the court on June 1, 2026. The deal covers all individuals whose personally identifiable information was compromised in the data breach experienced by HCF in September 2024.

Court documents state that approximately 70,000 people are covered by the settlement.

HCF Management settlement class members who submit a timely, valid claim form can receive up to $400 for documented out-of-pocket losses incurred between September 17, 2024 and September 29, 2026 due to the data breach. This benefit covers costs for credit reports, credit monitoring, identity theft insurance, bank fees, long-distance phone charges, notary fees, postage, gasoline, and more.

Class members can also receive up to $4,000 for documented “extraordinary” losses incurred between September 17, 2024 and September 29, 2026 due to the data breach. This benefit covers data breach-related bank fees, overdraft fees, interest on payday loans, and more.

Class members must submit proof, such as bank statements or receipts, to receive a documented-loss payment.

Additionally, class members can file a claim form for reimbursement of up to four hours of lost time spent responding to the data breach, at a rate of $20 per hour. Activities covered by this benefit include monitoring accounts, replacing credit/debit cards, filling out police reports, checking credit reports, communicating with financial institutions, and more.

In lieu of a documented-loss and/or lost-time payment, class members can submit a claim to receive a $35 cash payment, with no proof required.

Finally, all class members can elect on their claim form to receive three years of one-bureau credit monitoring, which includes fraud insurance.

To submit an HCF Management settlement claim form online, class members can head to this page and enter the login ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete, and return by mail to the settlement administrator.

All HCF Management claim forms must be submitted online or postmarked by September 29, 2026.

The court will determine whether to grant the HCF Management settlement final approval following a hearing on November 30, 2026. Benefits will begin to be made available to class members only after final approval has been granted and any appeals have been resolved.

The HCF Management class action lawsuit alleged that the long-term rehabilitative services provider failed to implement reasonable cybersecurity measures to protect private employee and customer information from a data breach on or around September 17, 2024.

Per court documents, private information that may have been compromised in the breach included Social Security numbers, dates of birth, financial account numbers, medical information, and insurance information.
