$685K Equinox Settlement Resolves Class Action Lawsuits Over April 2024 Data Breach

Equinox, Inc. has agreed to a $685,000 settlement to resolve two class action lawsuits that alleged the mental health services nonprofit failed to protect sensitive information in its care from an April 2024 data breach.

The Equinox class action settlement received preliminary approval from the court on June 25, 2026. The agreement covers all living United States residents who were sent a notice by Equinox that their private information may have been impacted in the data breach.

Court documents state that 21,565 people were sent notice of the cyber incident.

Equinox settlement class members who file a timely, valid claim form can receive up to $5,000 for documented out-of-pocket losses incurred between April 29, 2024 and October 23, 2026 due to the data breach. This benefit covers losses from fraud or identity theft and costs for credit monitoring services, bank fees, long-distance phone charges, postage, mileage, and more.

Class members must submit proof, such as bank statements or receipts, to receive a documented-loss payment.

Additionally, class members can submit a claim form to receive an estimated $100 pro rata cash payment, with no proof required.

The final amount of each class member’s payout may increase or decrease depending on the total number of valid claims filed, among other factors.

Further, class members can elect on their claim form to receive an enrollment code for three years of one-bureau credit monitoring, which includes dark web monitoring, identity theft insurance, and identity recovery services.

To submit an Equinox settlement claim form online, class members can head to this page and enter the ID and confirmation code found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete, and return by mail to the settlement administrator.

All Equinox claim forms must be submitted online or postmarked by October 23, 2026.

The court will determine whether to grant final approval to the Equinox settlement following a hearing on November 12, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.

The Equinox class action lawsuits alleged that the nonprofit organization based in Albany, New York, failed to implement reasonable cybersecurity measures to protect current and former patients’ private information from a data breach on or around April 29, 2024.

Court documents state that private information that may have been impacted by the breach included names, addresses, dates of birth, Social Security numbers, driver’s license numbers, health insurance information, medical treatment or diagnosis information, medication-related information, financial information, provider names, and MRN/patient IDs.
