Disability Rights Wisconsin Settlement Ends Class Action Lawsuit Over October 2023 Data Breach

Disability Rights Wisconsin has agreed to settle a class action lawsuit that alleged the nonprofit organization failed to implement adequate cybersecurity measures to prevent an October 2023 cyberattack that potentially compromised sensitive consumer information stored on its systems.

The Disability Rights Wisconsin class action settlement received preliminary approval from the court on December 16, 2025 and covers all United States residents whose private information was affected by the October 2023 data breach discovered by the nonprofit. Settlement documents indicate that there are approximately 19,150 settlement class members.

According to the settlement website, Disability Rights Wisconsin settlement class members who submit a timely, valid claim form may select one of the following forms of monetary reimbursement.

Class members who submit a claim form with documented proof of extraordinary losses incurred because of the data breach are eligible to receive up to $2,000 in reimbursement. Per the agreement, class members who submit a claim for extraordinary losses must include third-party documentation, such as receipts, invoices, or bank statements. Moreover, the losses covered under this category include professional fees, costs to freeze or unfreeze credit, credit monitoring costs incurred on or after the date settlement notices were mailed, and other miscellaneous expenses.

Class members are also eligible to receive reimbursement for up to four hours of lost time spent remedying issues related to the data breach at a rate of $21.25 per hour, for a maximum payout of $85 per class member. This payment is referred to as “Attestation Losses” in all court documents.

Importantly, settlement documents state that class members can choose to receive their cash payout in the form of a check or electronic payment, and checks must be cashed within 90 days of issuance before becoming void.

Finally, in addition to cash payments, all settlement class members are eligible to enroll in two free years of single-bureau credit monitoring and identity theft insurance. According to the settlement site, class members must affirmatively request credit monitoring on their claim form to receive this benefit, and enrollment codes will be sent to class members via email or to the address on their claim form.

To submit a Disability Rights Wisconsin settlement claim form, class members can visit this page and log in using the unique ID from their copy of the settlement notice and their last name. Alternatively, class members may download a PDF claim form to print, complete, and return by mail to the settlement administrator.

All Disability Rights Wisconsin claim forms must be submitted online or postmarked no later than April 15, 2026.

The court will determine whether to grant the Disability Rights Wisconsin settlement final approval at a hearing on April 30, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.

The Disability Rights Wisconsin class action lawsuit contended that the disability rights organization failed to prevent a data breach in or around October 2023 that allowed an unauthorized party to access and potentially misuse a significant amount of personal information, including names, treatment information, medical diagnoses, provider names, Social Security numbers, health insurance identification numbers, financial account information, dates of birth, and other private health information.
