A proposed class action lawsuit alleges that eos Products, LLC falsely markets some of its lip balms as “100% Natural,” even though the products contain synthetically processed, highly refined ingredients.

According to the 25-page lawsuit, two ingredients found in the eos lip balms at issue, stevia leaf extract and anisyl alcohol, are manufactured through multi-step processing and chemical manipulation. The case contends that the manufacturing processes used to create stevia leaf extract and anisyl alcohol are inconsistent with consumers’ understanding of what constitutes a truly natural ingredient.
“Any reasonable consumer would expect a product branded as ‘100% Natural’ to mean the Product is not made with, and does not contain, any artificial or synthetically made ingredients,” the class action lawsuit reads.
The complaint claims that eos contradicts its front-label marketing claims by listing stevia leaf extract and anisyl alcohol among the products’ ingredients on the back label.
According to the complaint, stevia leaf extract used in consumer products is made through multiple processing steps, including boiling, filtration, and concentration, culminating in what the suit describes as a “highly processed alcohol syrup” that is “no longer a natural ingredient.”
Similarly, the case says that anisyl alcohol is manufactured through a series of chemical reactions and refinements, including methylation, oxidation, extraction, reduction, and distillation. The result, the suit alleges, is a “synthesized, highly processed” fragrance component, not a natural substance.
The suit alleges that eos’s “100% Natural” marketing for its Strawberry Sorbet, Natural Shea, Watermelon Frosé & Lychee Martini, Pomegranate Raspberry, Coconut Milk, and Sweet Mint lip balm flavors is designed to “capitalize on market preferences” and consumer demand for natural products.
The eos lip balm class action lawsuit looks to represent all individuals in the United States who purchased eos lip balms advertised as “100% Natural” during the fullest period allowed by law.
