$1.05M Eisner Advisory Group Settlement Resolves Data Breach Lawsuit

Eisner Advisory Group has agreed to a $1,050,000 settlement to resolve a class action lawsuit that alleged the business consulting firm failed to protect personally identifiable information from a September 2023 data breach.

The Eisner Advisory Group class action settlement received preliminary court approval on June 11, 2026. The deal covers all individuals who were affected by the data breach, including, but not limited to, all who were sent a notice by Eisner concerning the cyber incident discovered in September 2023.

Court documents state that more than 82,000 people were affected by the Eisner Advisory Group data breach.

Eisner settlement class members who submit a timely, valid claim form can receive up to $5,000 for documented out-of-pocket losses incurred because of the data breach. This benefit covers losses from identity theft or fraud and costs for unreimbursed bank fees, long-distance phone charges, credit monitoring, postage, gasoline for local travel, and more.

Class members must submit proof, such as receipts or bank statements, to receive a documented-loss payment.

Class members can also submit a claim form to receive an estimated $100 pro rata cash payment, with no proof required.

The final amount of each class member’s cash payment may increase or decrease, depending on the total number of valid claims filed, among other factors.

Class members who are California residents may submit a claim for a $50 cash payment in addition to any other settlement benefits. Payments to California class members may be reduced on a pro rata basis, depending on how much remains in the settlement fund after the payment of legal fees and other settlement benefits.

Lastly, all class members can elect on their claim form to receive two years of single-bureau credit monitoring, which includes identity theft insurance.

To submit an Eisner Advisory Group settlement claim form online, class members can head to this page and log in using the claim ID and PIN found on their copy of the settlement postcard notice. Alternatively, class members can fill out and mail the tear-off claim form included with the notice or download a PDF notice and claim form to print, complete, and return by mail to the settlement administrator.

All Eisner settlement claim forms must be submitted online or postmarked by October 8, 2026.

The court will determine whether to grant final approval to the Eisner Advisory Group settlement following a hearing on October 13, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.

The Eisner Advisory Group class action lawsuit alleged that the accounting, tax and business consulting firm failed to implement reasonable cybersecurity measures to protect private information from a data breach between September 4 and September 9, 2023.

Per court documents, personally identifiable information that may have been compromised in the breach included names, Social Security numbers, financial account information, dates of birth, medical information, and health insurance information.
