Heritage South Credit Union Settlement Ends Class Action Lawsuit Over 2025 Data Breach

A Heritage South Credit Union settlement offers cash and financial monitoring to those whose info may have been affected by a Feb. 2025 data breach.
Heritage South Credit Union (HSCU) has agreed to a settlement to resolve a class action lawsuit that alleged the financial institution failed to protect confidential information in its care from a February 2025 data breach.

The Heritage South Credit Union class action settlement received preliminary approval from the court on May 18, 2026. The deal covers all living United States residents who were identified by HSCU and sent notice by the credit union that their private information may have been impacted in the data breach.

Settlement class members who file a timely, valid claim form can receive up to $2,000 for documented out-of-pocket losses incurred between February 12, 2025 and October 5, 2026 due to the data breach. This benefit covers losses from identity theft or fraud and costs for credit reports, credit monitoring, freezing or unfreezing credit, replacement IDs, postage, and more.
Class members must submit proof, such as bank statements or receipts, to receive a documented-loss payment.
Additionally, class members can file a claim form to receive reimbursement for up to four hours of lost time spent responding to the data breach, at a rate of $20 per hour. This benefit covers activities such as changing passwords, investigating suspicious activity, and researching the incident.
Finally, all class members can elect on their claim form to receive one year of CyEx Financial Shield Total, which includes monitoring for unauthorized transactions and financial fraud insurance.
To submit a Heritage South Credit Union settlement claim form online, class members can head to this page and enter the login ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete, and return by mail to the settlement administrator.
All HSCU settlement claim forms must be submitted online or postmarked by October 5, 2026.
The court will determine whether to grant final approval to the HSCU data breach settlement following a hearing on October 19, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Heritage South Credit Union class action lawsuit alleged that the Alabama-based credit union failed to implement reasonable cybersecurity measures to protect private information from a February 2025 data breach.
Per the lawsuit, private information that may have been compromised in the targeted cyberattack included names, addresses, Social Security numbers, or financial account numbers.
