Furmano’s Settlement Ends Class Action Lawsuit Over October 2024 Data Breach

Furman Foods Inc., doing business as Furmano’s, has agreed to a settlement to resolve a class action lawsuit that alleged the canned goods manufacturer failed to protect sensitive information in its care from an October 2024 data breach.

The Furmano’s class action settlement received preliminary approval from the court on June 3, 2026. The deal covers all United States residents whose personal information was potentially compromised in the October 2024 data breach affecting Furmano’s, including all who received notice of the incident.

Furmano’s settlement class members who submit a timely, valid claim form can receive up to $300 for documented “ordinary” out-of-pocket losses incurred between October 10, 2024 and September 30, 2026 due to the data breach. This benefit covers costs for credit reports, credit monitoring services, freezing or unfreezing credit, replacement IDs, postage, and more.

Additionally, class members can submit a claim for reimbursement of up to five hours of lost time spent responding to the incident, at a rate of $20 per hour. This benefit covers activities such as changing passwords, investigating suspicious account activity, and researching the Furmano’s data breach.

Claims for lost time will be included toward the $300 cap for out-of-pocket losses.

Class members can also file a claim form to receive up to $2,000 for documented “extraordinary” losses from identity theft or fraud incurred between October 10, 2024 and September 30, 2026 due to the Furmano’s data breach.

Class members must submit proof, such as receipts, to receive a payment for out-of-pocket expenses and/or identity theft- and fraud-related losses.

In lieu of any of the foregoing payouts, class members can submit a claim form to receive a $35 cash payment, with no proof required.

All Furmano’s claim forms must be submitted by September 30, 2026.

Lastly, all class members can enroll in two years of one-bureau credit monitoring, which includes dark web scanning and identity theft insurance.

The court will determine whether to grant final approval to the Furmano’s settlement following a hearing to be scheduled at a later date. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.

The Furmano’s class action lawsuit alleged that the canned food and condiment manufacturer failed to implement reasonable cybersecurity measures to protect the sensitive information on its systems from a targeted October 2024 cyberattack.

Court documents state that the private information that may have been impacted by the incident included names, addresses, and Social Security numbers.
