The Wright Brothers Construction Company class action settlement received preliminary approval from the court on May 5, 2026. The agreement covers all individuals whose personally identifiable information was compromised in the data breach, including all who received notice of the incident.
Court documents state that 4,780 people are covered by the settlement.
The court-approved website for the Wright Brothers Construction Company (WBCC) class action settlement can be found at WBCCSettlement.com.
WBCC settlement class members who submit a timely, valid claim form can receive up to $425 for documented ordinary losses incurred between April 3, 2024 and August 18, 2026 due to the data breach. This benefit covers the costs of credit reports, credit monitoring, freezing or unfreezing credit, replacement IDs, postage and more.
Class members can also file a claim form to receive up to $4,250 for documented extraordinary losses incurred between April 3, 2024 and August 18, 2026 due to the breach. This benefit covers losses related to identity theft or fraud that are not already covered by the ordinary-loss payout.
Class members must submit proof, such as receipts, to receive one or both documented-loss payments.
In addition, class members can file a claim form to receive compensation for up to four hours of lost time spent responding to the breach, at a rate of $23 per hour, for a maximum payout of $92. This benefit covers activities such as changing passwords, investigating suspicious activity, researching the data breach and more.
In lieu of any other cash payment, class members can submit a claim form to receive an alternative cash payment of $50 with no proof required.
Should the total value of filed claims exceed the aggregate cap of $500,000, class members’ payouts may be reduced on a pro rata basis.
Finally, all class members can file a claim form to receive three years of CyEx Identity Defense Complete, which includes dark web scanning, public records monitoring, credit monitoring and identity theft insurance.
To submit a WBCC claim form online, class members can head to this page and enter the login ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete, and return by mail to the settlement administrator.
All WBCC settlement claim forms must be submitted online or postmarked no later than August 18, 2026.
The court will determine whether to grant the WBCC settlement final approval following a hearing on August 18, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Wright Brothers Construction Company class action lawsuit alleged that the Tennessee-based construction company failed to implement reasonable cybersecurity measures to safeguard sensitive information on its systems, which allegedly led to a data breach between April 3, 2024 and April 5, 2024.
Per court documents, private information that may have been compromised in the breach included names and Social Security numbers.
