Up to $350K Oglethorpe Settlement Resolves Class Action Lawsuit Over June 2025 Data Breach

An up to $350K Oglethorpe settlement offers cash and medical monitoring to those who may have been affected by a June 2025 data breach.
Oglethorpe, Inc. has agreed to a settlement of up to $350,000 to resolve a class action lawsuit that alleged the behavioral healthcare group failed to protect sensitive information stored on its systems against a June 2025 cyberattack.

The Oglethorpe class action settlement received preliminary approval from the court on March 10, 2026. The deal covers all living United States residents who were sent notice from Oglethorpe that their private information may have been impacted in the June 2025 data breach.

According to the website, Oglethorpe settlement class members who file a valid, timely claim form can receive up to $2,500 for documented out-of-pocket losses stemming from the data breach.
This benefit covers expenses related to identity theft, fraud, fees for credit reports, credit monitoring, freezing and unfreezing credit, costs to replace IDs, and postage. Class members must include proof, such as bank statements or receipts, to receive a documented-loss payment.
In lieu of a documented-loss payment, class members may instead file a claim form to receive an alternative cash payment of approximately $75, with no proof required.
The settlement agreement states that cash payments are subject to an aggregate cap of $350,000. Should the value of monetary benefits from the settlement exceed $350,000, cash payments to class members may be proportionally reduced.
In addition to either cash payment option, all settlement class members will automatically receive an activation code via postcard for one free year of CyEx Medical Shield Complete, which includes one-bureau credit monitoring and identity theft insurance.
To file an Oglethorpe settlement claim form online, class members can head to this page and log in using the unique ID and PIN found on their copy of the settlement notice. Alternatively, class members may download a PDF of the claim form to print, fill out and return by mail to the settlement administrator.
All Oglethorpe settlement claim forms must be submitted online or by mail by July 8, 2026.
The court will determine whether to grant final approval to the Oglethorpe data breach settlement following a hearing on June 22, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The Oglethorpe class action lawsuit claimed that the Florida-based behavioral and mental healthcare management group failed to implement reasonable cybersecurity safeguards to protect the personal information of current and former patients and employees, which led to a cyberattack in June 2025.
Per court documents, private information that may have been accessible during the breach included names, Social Security numbers, driver’s license and state identification numbers, and medical information.
