Up To $290K Balance Autism Settlement Ends Class Action Lawsuit Over March 2025 Data Breach

Balance Autism has agreed to pay up to $290,000 to settle a class action lawsuit that alleged the autism service and therapy organization failed to protect the sensitive information stored on its systems from a March 2025 cyberattack.

The Balance Autism class action settlement received preliminary approval from the court on January 30, 2026 and covers all United States residents whose personal information may have been affected by the March 2025 data breach, including all those who received notice of the incident from Balance Autism.

According to the website, Balance Autism settlement class members who submit a timely, valid claim form have multiple options for reimbursement.
Class members who submit with their claim form documented proof of ordinary losses stemming from the Balance Autism data breach are eligible to receive a one-time cash payment of up to $400, the settlement site says.
The settlement agreement outlines that class members must submit with their ordinary-loss claim third-party documentation to receive compensation for unreimbursed expenses incurred between March 11, 2025 and June 1, 2026, specifically costs related to fraud or identity theft, including professional fees, freezing and unfreezing credit, credit monitoring, credit reports, and miscellaneous expenses, like postage and travel.
The agreement says that as part of the ordinary-loss settlement benefit, class members may also receive compensation for up to four hours of lost time spent responding to the data breach, at a rate of $20 per hour, subject to the $400 ordinary-loss payment cap.
Balance Autism settlement class members who submit with their claim form documented proof of extraordinary losses stemming from the data breach are eligible to receive a one-time cash payment of up to $4,000, court documents state.
According to the agreement, class members must include third-party documentation demonstrating that the extraordinary losses are actual and unreimbursed, were more likely than not caused by the breach, were incurred between March 11, 2025 and June 1, 2026, and are not already covered by another settlement benefit. Additionally, class members must be able to show that they made reasonable efforts to avoid or mitigate the claimed losses.
Balance Autism settlement class members may receive their payout via check or electronic payment, the agreement adds, and all checks must be cashed within 90 days of issuance before expiration.
In addition to any monetary benefits, all settlement class members can file a claim form to receive an enrollment code for two free years of one-bureau credit monitoring and identity theft protection insurance.
For participating class members who are under the age of 18, the agreement states that a parent or legal guardian may submit a claim form on their own behalf and on behalf of their minor child to receive a documented ordinary loss payment, reimbursement for lost time and/or extraordinary loss reimbursements.
In lieu of any other settlement benefits (except credit monitoring), settlement class members may instead file a claim form to receive a one-time alternative cash payment of $50.
The agreement notes that monetary benefits offered to class members are subject to a $290,000 aggregate cap, and all administrative expenses will be paid independently of this restriction. Should the total value of all approved claims for ordinary losses, lost time, extraordinary losses and alternative cash payments exceed this cap, all cash payments may be subject to a pro-rated reduction.
To file a Balance Autism settlement claim form online, class members can head to this page and log in using the claim number and PIN found on their received copy of the settlement notice. Alternatively, class members may download a PDF of the claim form from the site to print, fill out and return by mail to the address of the settlement administrator listed on the first page of the document.
All Balance Autism data breach claim forms must be submitted online or by mail by June 1, 2026.
Finally, as part of the settlement, Balance Autism has agreed to implement security enhancements to its systems that will be paid out separately from the settlement fund.
The court will determine whether to grant final approval to the Balance Autism data breach settlement following a hearing on June 12, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals are resolved.
The Balance Autism class action lawsuit alleged that the Iowa-based autism therapy and healthcare provider failed to implement proper cybersecurity measures to protect the sensitive information stored on its systems, which led to a data breach starting on or around March 11, 2025. Per court documents, the private information that may have been affected by the breach includes names, Social Security numbers, dates of birth, and health insurance/ Medicaid ID numbers.
