Payactiv Settlement Ends Data Breach Lawsuit

Payactiv has agreed to a class action settlement to resolve a lawsuit that alleged the financial wellness platform failed to protect sensitive information in its care from an April 2025 data breach.

The Payactiv class action settlement received preliminary approval from the court on June 12, 2026. The deal covers all living United States residents who were sent a notice from Payactiv that their private information may have been impacted by the data breach.
Court documents state that Payactiv sent data breach notices to 202,192 people who may have been impacted by the data incident.

Payactiv settlement class members who submit a timely, valid claim form can receive up to $2,500 for documented out-of-pocket losses incurred between April 3, 2025 and September 12, 2026 due to the data breach. This benefit covers losses from identity theft and fraud, as well as costs for credit reports, credit monitoring, freezing or unfreezing credit, replacement IDs, postage, and more.
Class members must submit proof, such as bank statements or receipts, to receive a documented-loss payment.
To submit a Payactiv settlement claim form online, class members can head to this page and enter the login ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete, and return by mail to the settlement administrator.
All Payactiv settlement claim forms must be submitted online or postmarked no later than September 12, 2026.
Additionally, all class members can enroll in two years of CyEx Financial Shield Complete, which includes financial fraud insurance, with no claim form required. Enrollment codes for credit monitoring were sent to all class members with their settlement notice.
The court will determine whether to grant the Payactiv settlement final approval following a hearing on October 12, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Payactiv class action lawsuit alleged that the financial services platform, which allows clients’ employees to access their earned wages before payday, failed to implement reasonable cybersecurity measures to protect sensitive information from a data breach that occurred between April 3 and April 20, 2025.
Per court documents, private information that may have been compromised in the breach included names, dates of birth, financial account numbers and Social Security numbers.
