Managed Care of North America Settlement Resolves Lawsuit Over 2023 Data Breach

Managed Care of North America, Inc., MCNA Insurance Company, and Healthplex, Inc. have agreed to a class action settlement to resolve a lawsuit that alleged the dental insurance companies and administrators failed to protect private information from a 2023 data breach.

The Managed Care of North America class action settlement received preliminary approval from the court on July 14, 2026. Eligible to participate in the settlement are all living United States residents who were sent a notice of the MCNA data breach stating that their private information was potentially impacted as a result of the incident.

Settlement class members who file a timely, valid claim form can receive up to $2,500 for documented out-of-pocket losses from identity theft or fraud caused by the data breach.

Class members must submit proof, such as receipts or correspondence, to receive a documented-loss payment.

Should the total value of all valid claims exceed the $250,000 cap on documented-loss payments, cash payouts will be reduced on a pro rata basis.

In addition, all class members are automatically eligible to receive two years of CyEx Medical Shield Complete, which includes identity theft insurance, medical data monitoring, and more. CyEx enrollment codes were sent to class members with their settlement notices, and the codes will become active within 30 days after the deal goes into effect.

To submit an MCNA settlement claim form online, class members can head to this page and enter the class member ID found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.

All Managed Care of North America settlement claim forms must be submitted online or postmarked by October 19, 2026.

The court will determine whether to grant final approval to the MCNA settlement following a hearing on November 16, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals are resolved.

The Managed Care of North America class action lawsuit alleged that the dental insurer and benefits manager failed to implement reasonable cybersecurity measures to protect private information from a data breach between February 26 and March 7, 2023.

Per court documents, confidential information that may have been compromised during the cyber incident included names, dates of birth, addresses, telephone numbers, email addresses, Social Security numbers, driver’s license or government-issued ID numbers, health insurance information, Medicaid or Medicare ID numbers, plan or group numbers, and information regarding dental and orthodontic care.
