Albany Gastroenterology Consultants, PLLC has signed on to a class action settlement to resolve a lawsuit that alleged the New York medical practice failed to protect private information on its computer systems from a targeted cyberattack in November 2024.

The Albany Gastro data breach settlement received preliminary approval from the court on June 16, 2026. The settlement covers all individuals who received direct notice that their private information may have been compromised as a result of the Albany Gastroenterology Consultants data breach.
Court documents state that roughly 57,751 people were impacted in the 2024 Albany Gastroenterology data breach.

Albany Gastro settlement class members who submit a timely, valid claim form can receive up to $2,500 for out-of-pocket losses incurred between November 10, 2024 and October 5, 2026 due to the data breach. This benefit covers expenses stemming from identity theft or fraud and costs of credit reports, credit monitoring, freezing/unfreezing credit, replacing IDs, and more.
Class members must submit proof, such as bank statements or receipts, to receive a documented-loss payout.
In lieu of a documented-loss payment, class members can file a claim form to receive a $10 cash payout, with no proof required. The amount of each class member’s cash payout may be larger or smaller, depending on the total number of valid claims filed.
Lastly, all settlement class members are eligible to enroll in two years of CyEx Medical Shield Complete, which includes medical identity theft insurance and medical record monitoring. CyEx enrollment codes have already been mailed to class members, and there is no need to submit a claim form to receive the service.

To file an Albany Gastro claim form online, class members can head to this page and enter the login ID and PIN found on their settlement notice. Alternatively, class members can download a PDF claim form to print, fill out, and send to the settlement administrator.
Albany Gastro settlement claim forms must be submitted online or by mail by October 5, 2026.
The court will determine whether to grant final approval to the Albany Gastroenterology Consultants settlement following a hearing on September 22, 2026. Settlement benefits will begin to be distributed, and medical data monitoring can be activated, once the deal has received final approval and any appeals are resolved.
The class action lawsuit against Albany Gastro alleged that the New York medical practice failed to protect the sensitive information of nearly 60,000 people from a targeted cyberattack in November 2024. Per the lawsuit, the practice’s subsequent investigation revealed that names, addresses, medical insurance details, Social Security numbers, and other personally identifiable and/or protected health information were impacted in the incident.
