Kipling Apparel Class Action Settlement Offers Store Vouchers to Consumers Allegedly Fooled by Fake Sales

A class action settlement ends litigation over Kipling Apparel Corp.'s alleged use of fake discounts.
A new class action settlement including store vouchers is set to resolve litigation over allegations that Kipling Apparel Corp. advertised fake sales in its outlet stores and deceived customers into thinking they were paying discounted prices.

The Kipling settlement received preliminary court approval on May 29, 2025 and covers anyone in the U.S. who, between December 8, 2019 and May 29, 2025, bought one or more items from Kipling’s California outlet stores that were advertised as discounted from a reference price and who has not already received credit or a refund for the purchase or purchases.

Settlement class members who got an email notice of the settlement will receive a single-purchase, non-transferable voucher for up to $10 to be used in any of Kipling’s California outlet stores. No action on the part of these class members is required to receive the voucher; it will be sent directly to their email address within 60 days of the settlement becoming final.
Class members who did not receive an email notice may still receive a voucher by submitting a timely, valid claim form.
To file a claim online, navigate to this page, click the “Start Your Claim” button and enter the relevant information. Alternatively, a PDF claim form is available to print, fill out and mail back to the address listed in bold in the acknowledgment section of the form.
Class members who file a claim may need to submit additional information to support it if required by the settlement administrator.
All claims must be submitted or postmarked by September 25, 2025.
There will be a court hearing on October 3, 2025 to determine if the settlement will receive final approval from the court. Vouchers will only be distributed if final approval is granted and after any appeals are resolved.
The Kipling Apparel Corp. class action lawsuit claimed that Kipling advertised fake sales in its California outlet stores in order to deceive customers into thinking they were paying a discounted price when they were really paying the item’s true retail price.
