A Furniture Mart USA settlement resolves a class action lawsuit that alleged the furniture and mattress retailer failed to safeguard personal information from a November 2024 data breach.

The Furniture Mart USA class action settlement received preliminary approval from the court on June 15, 2026. Eligible to participate in the settlement are all United States residents whose personal information was potentially compromised in the data breach.
Court documents state that Furniture Mart USA sent data breach notices to 10,684 people.

Furniture Mart settlement class members who submit a timely, valid claim form can receive up to $4,500 for documented out-of-pocket losses stemming from the cyber incident. This benefit covers losses from identity theft or fraud and costs for credit reports, credit monitoring, freezing/unfreezing credit, replacement IDs, postage, and more.
Class members must submit proof, such as bank statements or receipts, to receive a documented-loss payment.
Further, all class members can submit a claim form to receive reimbursement for up to four hours of lost time spent addressing the breach, at a rate of $25 per hour. This benefit covers time spent changing passwords, monitoring accounts for suspicious activity, and researching the data breach.
Claims for lost time will be included in the $4,500 aggregate cap for documented-loss payments.
In lieu of a documented-loss and/or lost-time payment, class members can file a claim form to receive a $75 cash payment, with no proof required.
Lastly, all class members can elect on their claim form to receive three years of CyEx Identity Defense Complete, which includes credit monitoring and identity theft insurance.
To submit a Furniture Mart USA settlement claim form online, class members can head to this page and enter the login ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.
All Furniture Mart settlement claim forms must be submitted online or postmarked by November 3, 2026.
The court will determine whether to grant final approval to the Furniture Mart settlement following a hearing on November 9, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Furniture Mart USA class action lawsuit alleged that the furniture retailer based in Sioux Falls, South Dakota, failed to implement reasonable cybersecurity measures to protect personal information, including names, Social Security numbers and dates of birth, from a data breach that occurred on November 3, 2024.
