A former assistant manager has filed a lawsuit in Arkansas against Allied Food Industries, Inc., which operates a Burger King restaurant in Little Rock, over claims that she wasn’t paid proper overtime wages. According to the complaint, the plaintiff worked as an assistant manager exempt from Fair Labor Standards Act (FLSA) overtime obligations and was required to work at least 45 hours per week. Despite her managerial title, the plaintiff says she primarily worked to prepare food, clean the restaurant and serve customers. As a result, the suit alleges, the plaintiff should have instead been classified as a non-exempt employee entitled to overtime pay.
