CPAP Medical Supplies and Services Settlement Resolves Lawsuit Over 2024 Data Breach

CPAP Medical Supplies and Services, Inc. has agreed to a class action settlement to resolve a lawsuit that alleged the sleep apnea equipment company failed to protect current and former patients’ and employees’ sensitive information from a December 2024 cyberattack.

The CPAP Medical Supplies and Services class action settlement received preliminary approval from the court on July 29, 2026. Eligible for the settlement are all living United States residents who were sent a notice by CPAP Medical Supplies and Services stating that their private information may have been impacted in the data breach.  

Court documents state that nearly 90,000 people may have been impacted by the data breach.

Settlement class members who file a timely, valid claim form can receive up to $5,000 for documented out-of-pocket losses incurred between December 13, 2024 and November 26, 2026 due to the data breach. This benefit covers losses from identity theft or fraud and costs for credit reports, credit monitoring, freezing/unfreezing credit, replacement IDs, postage, and more.

Class members must include proof, such as bank statements or receipts, to receive a documented-loss payment.

Should the total amount of all documented-loss claims exceed $500,000, payments to class members will be reduced on a pro rata (proportional) basis.

In addition, class members can elect on their claim form to receive two years of CyEx Medical Shield Complete, which includes medical identity theft insurance and medical data monitoring.

To submit a CPAP Medical Supplies and Services claim form online, class members can head to this page and enter the login ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.

All CPAP Medical Supplies and Services settlement claim forms must be submitted online or postmarked by November 26, 2026.

The court will decide whether to grant final approval to the CPAP Medical Supplies data breach settlement following a hearing on December 1, 2026. Settlement benefits will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.

The CPAP Medical Supplies and Services class action lawsuit alleged that the medical equipment company, which provides sleep therapy equipment to active-duty and retired military servicemembers, failed to implement adequate cybersecurity protections to safeguard private information from a December 2024 data incident.

Court documents state that personal information that may have been compromised in the data breach included names, physical addresses, email addresses, telephone numbers, Social Security numbers, driver’s license numbers, health insurance information, medical histories, treatment plans, and financial information.
