$950K Peco Foods Settlement Wraps Up Data Breach Lawsuit

Peco Foods has agreed to a $950,000 class action settlement to wrap up a lawsuit that alleged the poultry processor failed to protect personal information from unauthorized access during a December 2023 data breach.

The Peco Foods class action settlement received preliminary approval from the court on July 12, 2026. Eligible to participate in the settlement are all United States residents who received written notice from Peco that their personally identifiable information may have been compromised in the data breach.

Court documents state that approximately 46,442 people are included in the settlement class.

Peco Foods class members who submit a timely, valid claim form can receive up to $1,000 for documented “ordinary” out-of-pocket losses incurred on or after December 4, 2023 because of the data breach. This benefit covers costs for credit reports, credit monitoring, freezing credit, bank fees, unauthorized card charges, transportation expenses, long-distance phone charges, postage, and more.

In addition, class members can file a claim form to receive up to $5,000 for documented “extraordinary” losses incurred on or after December 4, 2023 due to the breach. This benefit covers losses from identity theft or fraud that are not already covered by another settlement benefit.

As part of the extraordinary-loss benefit, class members can also submit a claim for up to 10 hours of lost time spent addressing issues related to the data breach, at a rate of $40 per hour.

Class members must submit proof, such as bank statements or receipts, to receive a documented-loss payment.

In addition to or in lieu of a documented-loss payment, class members can submit a claim form to receive a cash payment of up to $550, with no proof required. The final amount of each class member’s payment will be determined based on the total number of valid claims filed, among other factors.

Finally, all class members can elect on their claim form to receive three years of three-bureau credit monitoring.

To submit a Peco Foods settlement claim form online, class members can head to this page and enter the settlement claim ID found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.

All Peco Foods settlement claim forms must be submitted online or postmarked by November 9, 2026.

The court will determine whether to grant final approval to the Peco Foods data breach settlement following a hearing on December 14, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
