$5.3M SitusAMC Settlement Resolves Class Action Lawsuit Over 2025 Data Breach

SitusAMC Holdings Corporation has agreed to a $5.3 million settlement to resolve a class action lawsuit that alleged the real estate finance advisory firm failed to protect private information from a November 2025 data breach.

The SitusAMC class action settlement received preliminary approval from the court on June 29, 2026. Eligible to participate in the settlement are all individuals in the United States who were sent notice of the SitusAMC data breach, as identified in the class list.

Court documents state that the class list includes approximately 662,796 people covered by the settlement.

SitusAMC settlement class members who submit a timely, valid claim form can receive up to $5,000 for documented out-of-pocket losses stemming from the data breach. This benefit covers unreimbursed costs for credit monitoring and identity theft protection purchased between November 12, 2025 and November 6, 2026, charges from banks or credit card companies, replacement driver’s licenses or Social Security numbers, credit reports, and more.

Class members must submit proof, such as bank statements or receipts, to receive a documented-loss payment.

In lieu of or in addition to a documented-loss payout, all class members can file a claim form to receive an estimated $75 cash payment, with no proof required.

The final amount of each class member’s cash payment may increase or decrease on a pro rata basis, depending on the total number of valid claims filed, among other factors.

Class members who resided in California between November 12 and November 22, 2025 can receive an additional $50 cash payment, the final amount of which may be reduced on a pro rata basis, depending on the number of valid claims filed.

Lastly, all class members are automatically eligible to enroll in one year of credit monitoring through CyEx Financial Shield Complete, which includes dark web scanning, public records monitoring, identity restoration and recovery services, and identity theft insurance. Information on how to receive the credit monitoring was mailed to class members as part of the postcard settlement notice.

To submit a SitusAMC settlement claim form online, class members can head to this page and enter the login ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator. 

All SitusAMC settlement claim forms must be submitted online or postmarked by November 6, 2026.

The court will determine whether to grant final approval to the SitusAMC settlement following a hearing on November 11, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.

The SitusAMC class action lawsuit alleged that the real estate finance technology and service firm failed to take reasonable steps to safeguard personal information from a data breach on or around November 12, 2025.

Court documents state that confidential information that may have been compromised in the cyber incident included names, dates of birth, Social Security or individual taxpayer ID numbers, driver’s license numbers, state ID or other government-issued ID numbers, financial account numbers, medical records, and health insurance policy numbers.
