The Innovative Renal Care class action settlement received preliminary approval from the court on August 5, 2026. Eligible for the settlement are all living individuals who were sent a notice from IRC regarding potential impact from the data incident discovered by Innovative Renal Care on or around February 29, 2024, or otherwise determined to have potentially had their personal information impacted by the data breach.
Court documents state that the private information of approximately 59,400 people may have been compromised in the data breach.
The court-authorized Innovative Renal Care class action settlement website can be found at IRCSettlement.com.
Settlement class members who file a timely, valid claim form can receive up to $5,000 for documented out-of-pocket losses incurred due to the data breach. This benefit covers unreimbursed losses from identity theft or fraud; costs for credit monitoring services incurred on or after February 14, 2025 through December 21, 2026; and bank fees, long-distance phone charges, postage, mileage, and more.
Class members must submit proof, such as credit card statements, to receive a documented-loss payment.
In addition to or instead of a documented-loss payment, class members can file a claim form to receive an estimated $100 pro rata (proportional) cash payment, with no proof required.
The final amount of each class member’s pro rata cash payout may be higher or lower, depending on the total number of valid claims filed, among other factors.
Lastly, class members can elect on their claim form to receive two years of one-bureau credit monitoring, which includes dark web monitoring, fully managed identity recovery services, and identity theft insurance.
To submit an Innovative Renal Care settlement claim form online, class members can navigate to this page and enter the class member ID found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.
All Innovative Renal Care settlement claim forms must be submitted online or postmarked by December 21, 2026.
The court will determine whether to grant final approval to the Innovative Renal Care data breach settlement following a hearing on February 1, 2027. Benefits will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The American Renal Management class action lawsuit alleged that the network of dialysis centers and providers failed to implement adequate cybersecurity measures to protect IRC patients’ and current and former employees’ sensitive information from a data breach that occurred between February 21, 2024 and March 1, 2024.
Court documents state that personal information that may have been compromised during the cyberattack included names, addresses, dates of birth, Social Security numbers, driver’s license or state ID numbers, financial account information, taxpayer ID numbers, electronic signatures, health insurance information, medical billing/claim information, medical diagnoses or condition information, medical prescription information, medical record numbers, treatment information, patient account numbers and/or patient ID numbers.
