A $500,000 class action settlement will end litigation that alleged Progressive Direct Insurance Company sent debt collection-related emails to Florida residents outside the daily time frame allowed under state law.

The Progressive class action settlement received preliminary approval from the court on July 31, 2025 and covers all Florida residents who, between July 2, 2022 and May 16, 2025, received a Florida debt collection email from Progressive between the hours of 9:00 pm and 8:00 am local time.
A “Florida debt collection email” is defined for the purposes of the class action settlement as any billing-related email—billing installment, billing reminder, billing lapse—cancel-related email, or similar email relating to a Florida insurance policy covering property used primarily for personal, family or household purposes.
The court-approved website for the Progressive email settlement can be found at ElectronicCommsSettlement.com.
Progressive settlement class members who submit a timely, valid claim form can receive a pro rata, or equal share, payout from the $500,000 settlement fund.
Settlement payouts to eligible class members will not exceed $1,000 per person, the settlement website notes.
To submit a claim form online, class members can visit this page and log in with the unique class member ID found in their copy of the settlement notice.
Alternatively, a PDF of the claim form is available to print, fill out and mail back to the address listed on the first page of the form.
All claim forms must be submitted online or postmarked by November 24, 2025.
A hearing is scheduled for December 8, 2025 to determine whether the Progressive debt collection email class action settlement will receive final court approval. Payments will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The Progressive Insurance class action lawsuit claimed that the company sent debt collection-related emails to Florida residents outside the legal hours for such communications, in violation of Florida’s Consumer Collection Practices Act.
