Aspire Health Alliance has agreed to a $400,000 settlement to resolve a class action lawsuit that alleged the behavioral healthcare center failed to protect sensitive patient and employee information from a September 2023 data breach.

The $400,000 Aspire Health Alliance settlement received preliminary court approval on June 4, 2026. The deal covers all living individuals who were sent a notice by South Shore Mental Health Center (doing business as Aspire Health Alliance) that their private information may have been impacted in the September 2023 data breach.

Aspire Health settlement class members who submit a timely, valid claim form can receive up to $2,500 for documented out-of-pocket losses arising from the data breach. This benefit covers losses incurred between September 13, 2023 and September 16, 2026 due to identity theft and fraud and costs for freezing and unfreezing credit, credit monitoring, notary, fax, postage, copying, mileage, long-distance telephone charges, and more.
Class members must submit proof, such as receipts or bank statements, to receive a documented-loss payment.
Class members who do not submit a claim for documented out-of-pocket losses will automatically receive a pro rata cash payment from the settlement. These individuals can update their address or choose a digital payment on this page.
Finally, all class members will receive one year of CyEx Medical Shield Complete, which includes medical record monitoring and medical identity theft insurance. To receive a reminder email containing enrollment instructions for medical data monitoring once the settlement becomes final, head to this page and enter your login ID and PIN to proceed.
To submit an Aspire Health settlement claim form online, class members can head to this page and enter the login ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete, and return by mail to the settlement administrator.
All Aspire Health Alliance settlement claim forms must be submitted online or postmarked no later than September 16, 2026.
The court will determine whether to grant the Aspire Health Alliance settlement final approval following a hearing on October 1, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Aspire Health Alliance class action lawsuit alleged that the Massachusetts-based healthcare provider, which offers intervention, mental health treatment, and recovery programs, failed to implement reasonable cybersecurity measures to protect the private information of current and former patients and employees from a data breach discovered on or around September 13, 2023.
Per court documents, private information that may have been compromised in the breach included names, dates of birth, dates of medical services, individual health insurance policy numbers, physician or medical facility information, medical condition or treatment information, Medicare or Medicaid numbers, and patient account numbers.
