The $549,000 Drug and Alcohol Treatment Services class action settlement received preliminary court approval on May 12, 2026. The agreement covers all individuals in the United States whose personal information was impacted by the data breach publicly announced by DATS in May 2025, including all who were sent notice of the breach.
Court documents state that approximately 22,215 people were notified that their private information may have been implicated in the data breach.
The court-approved website for the DATS class action settlement can be found at DATSDataBreachSettlement.com.
DATS settlement class members who submit a timely, valid claim form can receive up to $5,000 for documented out-of-pocket losses incurred due to the data breach. This benefit covers costs for unreimbursed bank fees, long-distance phone charges, cell phone charges if charged by the minute, data charges, postage, travel, credit reports and monitoring, and more.
Class members must submit proof, such as bank statements and receipts, to receive a documented-loss payment.
In lieu of a documented-loss payment, class members can file a claim form to receive an alternative cash payment, with no proof required.
The final amount of this payment may increase or decrease depending on the number of claims filed, among other factors.
Finally, all class members can file a claim form to receive one year of CyEx Medical Shield, which includes medical identity theft monitoring.
To submit a DATS settlement claim form online, class members can head to this page and enter the class member ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, fill out and return by mail to the settlement administrator.
All Drug and Alcohol Treatment Services settlement claim forms must be submitted online or postmarked by September 24, 2026.
Drug and Alcohol Treatment Services has also agreed as part of the settlement to maintain or implement data and information security measures for a period of five years.
The court will determine whether to grant the DATS settlement final approval following a hearing on November 24, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Drug and Alcohol Treatment Services class action lawsuit alleged that the Scranton, Pennsylvania-based addiction treatment provider failed to implement reasonable cybersecurity measures to protect the private information of its current and former patients, leading to a data breach between October 5 and 6, 2024.
Per court documents, private information that may have been compromised during the breach included patient names, addresses, dates of birth, Social Security numbers, health insurance information, patient account numbers, medication information, diagnosis and treatment information, doctors’ names, and medical claims and billing information.
