Settlement class members who submit a timely, valid claim form can receive up to $3,500 for out-of-pocket losses incurred because of the data breach. This benefit covers costs for credit reports and credit monitoring services purchased between December 12, 2024 and July 30, 2026, and expenses for bank fees, long-distance phone charges, postage, gasoline, and more.
As part of this benefit, class members can also receive reimbursement for up to four hours of lost time spent addressing the data breach, at a rate of $20 per hour. Class members can only receive compensation for lost time if they spent at least one hour responding to the breach.
Class members must submit proof, such as receipts or bank statements, to receive a documented-loss payment.
In lieu of a documented-loss payment, class members can instead file a claim form to receive an alternative $50 cash payment, with no proof required.
Class members who were California residents when the Nth Degree data breach occurred can claim an additional $100 cash payment.
Finally, all settlement class members can submit a claim to receive three years of single-bureau credit monitoring, which includes dark web monitoring, identity theft insurance, and identity recovery assistance.
To submit an Nth Degree claim form online, class members can head to this page and enter the notice ID found on their copy of the settlement notice and their last name. Alternatively, class members can log in on the same page to download a PDF claim form to print, complete, and return by mail to the settlement administrator.
All Nth Degree settlement claim forms must be submitted online or postmarked by July 30, 2026.
The court will determine whether to grant the Nth Degree settlement final approval following a hearing on August 19, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Nth Degree class action lawsuit alleged that the trade show and event management company failed to implement reasonable cybersecurity measures to safeguard private information in its possession, allegedly leading to a data breach between December 12 and December 20, 2024.
Per court documents, sensitive information that may have been accessed or acquired during the breach included first and last names, addresses, dates of birth, Social Security numbers, state ID or driver’s license numbers, bank account information, and health information.
