$4.7M Neutrogena Settlement to End Class Action Lawsuit over Alleged BIPA Violations

Johnson & Johnson has agreed to a $4,700,000 settlement to resolve a class action lawsuit that claimed the cosmetics company unlawfully collected and stored the facial scans of consumers in violation of the Illinois Biometric Information Privacy Act (BIPA).

The plaintiffs asked the court to grant preliminary approval of the $4.7 million Neutrogena class action settlement on February 17, 2026. The proposed deal would cover all individuals who, while in Illinois, performed a Skin360 skin assessment using any version of Skin360, including Neutrogena Skin360, Neostrata Skin360, and any Skin360 collaborations with other entities, whether via mobile app or web browser, between December 9, 2019 to May 5, 2023 (the “Class Period”).
Settlement documents estimate that there are approximately 11,000 Neutrogena settlement class members.

According to court documents, the proposed Neutrogena settlement would provide to class members who submit a timely, valid claim form a one-time, pro-rated cash payment. The agreement stipulates that the final amount of this payment is estimated to be hundreds of dollars as a share of the net settlement fund after all administrative expenses, attorney’s fees, and lead plaintiff service awards have been paid.
Importantly, the proposed Neutrogena settlement orders that Johnson & Johnson must delete all images obtained during Skin360 skin assessments during the class period. Furthermore, the agreement orders that that the company create a user notice and written consent form for Skin360 and implement a written policy concerning the retention and destruction of biometric information.
Neutrogena settlement class members will have the option to submit their claim forms online via the forthcoming settlement website or by mail. As stated by the agreement, class members must include with their claim form a written attestation under penalty of perjury that they were in Illinois and used the Skin360 tool during the class period.

The Neutrogena class action lawsuit alleged that the facial scans of Illinois residents were unlawfully collected and stored by Johnson and Johnson, the parent company of Neutrogena, via its online personal skin assessment tool. The case argues that Neutrogena did not obtain informed consent from users and did not disclose the collection and use of biometric information obtained in the Skin360 scan in violation of the Illinois Biometric Information Privacy Act.
The motion urges the court to approve the proposed settlement, saying “[i]n the absence of settlement, the litigation would likely be expensive, long, and complex.”
