$4.2M+ Telmate Settlement Ends Class Action Lawsuit Over 2020 Data Breach

A $4.2M+ Telmate class action settlement offers cash to users whose info was impacted by a 2020 data breach.
Telmate, LLC, doing business as ViaPath Technologies, has agreed to a $4,225,000 class action settlement to resolve a lawsuit that alleged the communication services provider for incarcerated individuals failed to protect users’ personal information from an August 2020 data breach.

The Telmate class action settlement received preliminary approval from the court on August 19, 2026. Eligible for the settlement are all individuals in the United States whose personal information was impacted during the data breach experienced by Telmate (Viapath Technologies) on or around August 13, 2020.
Court documents state that approximately 431,031 people are included in the settlement class.
The court-approved Telmate class action settlement website can be found at TelmateDataBreachSettlement.com.
Telmate class members who file a timely, valid claim form can receive up to $5,000 for documented, unreimbursed out-of-pocket losses incurred due to the data breach.
Class members must submit proof, such as receipts, to receive a documented-loss payment.
In addition, class members can file a claim form to receive a pro rata (proportional) cash payment, with no proof required.
The final amount of each class member’s pro rata cash payment will be determined based on the total number of valid claims filed, among other factors.
To submit a Telmate settlement claim form online, class members can head to this page and enter the class member ID found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.
All Telmate data breach settlement claim forms must be submitted online or postmarked by December 21, 2026.
The court will determine whether to grant final approval to the Telmate settlement following a hearing on February 12, 2027. Settlement benefits will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Telmate class action lawsuit alleged that the company, which does business as Viapath Technologies and provides communication services to incarcerated individuals and their families through platforms such as GettingOut, VisitNow, Command, Telmate Inmate Telephone, and Guardian, failed to implement adequate cybersecurity measures to protect users’ private information from a data breach that occurred between August 11 and August 13, 2020.
Court documents state that private information that may have been compromised during the data incident included full names, dates of birth, phone numbers, email addresses, and usernames paired with passwords, home addresses, driver’s license numbers, passport numbers, Social Security numbers, payment card numbers, and financial account information.
