The Athena Cosmetics class action settlement received preliminary approval from the court on December 29, 2025 and covers all consumers in the United States and its territories who purchased any of the following products for personal or household use between January 1, 2017, and December 29, 2025:
- RevitaLash® Advanced Eyelash Conditioner;
- RevitaLash® Advanced Sensitive Eyelash Conditioner;
- RevitaLash® Advanced Pro Eyelash Conditioner; and
- RevitaBrow® Advanced Eyebrow Conditioner.
The court-approved website for the Athena Cosmetics settlement can be found at EyeSerumSettlement.com/.
According to the website, Athena Cosmetics settlement class members who submit a timely, valid claim form will be able to select between a cash payment and a voucher credit that can be put towards any purchase made on RevitaLash.com.
Settlement documents state that class members who submit a claim form and either appear in Athena’s internal records or provide proof of purchase are eligible to receive a one-time, pro-rated cash payment or a voucher credit of approximately $110 for each product claimed. In other words, class members who submit proof that they purchased more than one eligible product are eligible to receive additional cash payments and/or additional vouchers.
The final amount of this cash payment, the settlement site reports, will be determined by the total number of valid claims filed and what remains in the net settlement fund after payment of attorneys’ fees, settlement administration costs, lead plaintiff service awards, and any other litigation expenses. However, the site notes that any pro-rated reductions will not reduce the value of the cash payment to less than $20.
Class members who are not in Athena’s records and have no proof of purchase may still file a claim form to receive a one-time, pro-rated cash payment or an approximately $110 voucher credit with no proof required. The settlement site outlines that these class members will be limited to one cash payment or one voucher credit per household.
Upon filing a claim form, class members may elect to receive their payout via check or electronic payments, the agreement explains. Voucher credits will be issued by the settlement administrator as a unique, non-expiring code.
To submit an Athena Cosmetics claim form online, class members can head to this page and complete all required fields with relevant information to receive benefits. Class members who received a settlement notice may also enter the unique notice identification number they were provided, which reflects their inclusion in Athena’s records.
Alternatively, class members may download a PDF of the claim form from the settlement website to print, fill out, and return by mail to the address of the settlement administrator listed near the top of the document.
All Athena Cosmetics settlement claim forms must be submitted online or by mail by April 20, 2026.
Consumers who have difficulty filing a claim form—or have any other outstanding questions about the settlement—may contact the settlement administrator for more information.
Finally, as part of the settlement, Athena Cosmetics has also agreed to change the labels and packaging of its products and alter product descriptions on its website to more accurately reflect the health risks of its lash and brow serums.
The court will determine whether to grant final approval to the Athena Cosmetics settlement at a hearing on May 21, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals have been resolved.
The Athena Cosmetics class action lawsuit alleged that the beauty company failed to adequately warn consumers of the significant risks of using its RevitaLash and RevitaBrow solutions, and similarly failed to disclose side effects that may occur after using its eye serums. The lawsuit further asserted that the active ingredient in the hair growth products, dechloro dihydroxy difluoro ethylcloprostenolamide (DDDE), is known to cause blepharitis, Meibomian Gland Dysfunction (MGD), chronic dry eye, redness, discoloration, pain or irritation, and other serious side effects.
