A $3.7M Duke University Health System settlement offers cash to patients whose health information may have been disclosed to third parties.
Duke University Health System has agreed to a $3,743,600 settlement to resolve a class action lawsuit that alleged the healthcare provider implemented tracking pixels into its patient portal that transmitted personal health information to third parties for targeted advertising purposes.

The $3.7 million Duke University Health System class action settlement received preliminary approval from the court on March 19, 2026 and covers all individuals in the United States who logged into the Duke MyChart patient portal or MyDuke Health mobile app at least once between February 18, 2019 and June 17, 2022.
Court documents indicate that approximately 872,634 individuals are covered under the Duke University Health System settlement.

According to the agreement, Duke Health settlement class members who submit a timely, valid claim form are eligible to receive a one-time cash payment from the settlement fund. Settlement documents state that each class member’s payment will be a pro rata, or equal share, portion of the net settlement fund after the deduction of attorneys’ fees, administration expenses and lead plaintiff service awards.
Class members may receive their settlement payout via check or electronic payment, the agreement adds, and all checks must be cashed within 90 days of issuance before expiration.

Per court documents, class members who wish to exclude themselves from the deal and retain any legal rights must send a request for exclusion to the settlement administrator no later than July 20, 2026. Similarly, class members who want to object to the settlement must submit a written objection to the court by the same date.
The court will determine whether to grant the Duke Health settlement final approval following a hearing on August 27, 2026. Compensation will only be distributed to class members after final approval has been granted and any appeals have been resolved.
The Duke University Health System class action lawsuit alleged that the North Carolina-based healthcare system installed tracking pixels in its Duke MyChart online patient portal and MyDuke Health mobile app that collected and covertly transmitted patients’ private health information to third parties, including Meta.
