Farmers Insurance has agreed to a $2,875,000 settlement to resolve a class action lawsuit that alleged telemarketing calls and text messages were placed to consumers in violation of the federal Telephone Consumer Protection Act (TCPA).

The $2,875,000 Farmers Insurance class action settlement received preliminary approval from the court on April 28, 2026.
The agreement covers all individuals who, from October 8, 2020 through April 28, 2026, received two or more calls or texts from Todd Henderson Insurance Agency, Inc. and/or R. Todd Henderson regarding Farmer’s products or services during a 12-month period, whose number was on the Do Not Call Registry for more than 30 days at the time the correspondence was received, and whose number is registered to an individual, not a business.
Court documents state that approximately 8,039 people are covered by the class action settlement.

Farmers settlement class members who file a valid, timely claim form can receive a pro rata cash payment of up to $425. The amount of each class member’s payout may decrease, depending on the total number of valid claims submitted.
To file a Farmers settlement claim form online, class members can head to this page and log in using the notice ID listed on their copy of the settlement notice and their last name. Alternatively, class members can download a PDF of the claim form to print, fill out, and return by mail to the settlement administrator.
All Farmers Insurance settlement claim forms must be submitted online or by mail by July 24, 2026.
The court will determine whether to grant final approval to the Farmers Insurance settlement following a hearing on July 31, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The Farmers Insurance class action lawsuit alleged that the vehicle, home and small business insurance provider’s agents violated the federal Telephone Consumer Protection Act by placing telemarketing calls and texts to consumers whose phone numbers were registered on the National Do-Not-Call Registry.
