The $4.75 million Hy Cite class action settlement received preliminary approval from the court on March 24, 2026. The settlement covers all individuals in the United States to whom the company placed or directed a call to a cell phone number not assigned to a Hy Cite customer or accountholder, where the call used an artificial or prerecorded voice, at any time from October 22, 2020 through September 10, 2025.
The court-approved website for the Hy Cite Enterprises robocall settlement can be found at HyCiteTCPASettlement.com.
According to the website, Hy Cite settlement class members who file a valid, timely claim form can receive a pro rata cash payment from the deal. The final amount of each class member’s payment will depend on the total number of valid claims filed and how much remains in the settlement fund after the payment of court-approved fees and expenses.
Per the preliminary approval order, the parties represent that the amount each class member stands to receive from the settlement is “likely to be between $650 and $1,000.”
Should enough money remain in the settlement fund after the first distribution of payouts, class members may receive a second payment of at least $25, court documents state. Any remaining funds, regardless of whether a second distribution occurs, will be donated as a cy pres award.
To file a Hy Cite settlement claim form online, class members can head to this page and enter the class member ID found on their copy of the settlement notice.
Alternatively, class members can file a Hy Cite claim form by filling out the physical form they received by mail with their settlement notice to return by mail to the settlement administrator.
All Hy Cite Enterprises settlement claim forms must be submitted online or by mail by July 8, 2026.
The court will determine whether to grant final approval to the Hy Cite Enterprises settlement following a hearing on October 6, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The Hy Cite Enterprises class action lawsuit claimed that the direct-to-distributor kitchen and houseware goods retailer violated the federal Telephone Consumer Protection Act by placing calls that used an artificial or prerecorded voice to the cell phone numbers of consumers who were not customers or accountholders and had not given prior express consent.
