$13.5M LexisNexis Settlement Ends Class Action Lawsuit Over Allegedly Wrongful Death Reports

A $13.5M class action settlement offers cash to those who LexisNexis FL may have allegedly reported as deceased when they were, in fact, alive.
LexisNexis Risk Solutions FL has agreed to a $13,500,000 settlement to resolve a class action lawsuit that accused the data analytics company of wrongfully reporting death notations for consumers who were, in fact, alive.

The LexisNexis class action settlement received preliminary approval from the court on November 4, 2025 and covers two distinct groups of consumers:
- All individuals who, between August 11, 2017 and November 4, 2025, contacted LexisNexis FL to inquire about a deceased notation on a company product and for which LexisNexis FL has a record of the inquiry that identifies it as related or comparable to “deceased,” “death,” or “dead” (the “Contact Members” class); and
- All individuals about whom LexisNexis FL, between August 11, 2017 and November 4, 2025, ran an identity verification and/or fraud prevention transaction for which the company has a record that the transaction returned a deceased notation, for which LexisNexis FL’s system reflected a deceased notation associated with the individual’s identifying information received from national credit reporting agencies, and the individual was not deceased (the “Product Members” class).
Per court documents, approximately 1,700 people are included in the Contact Members class, and approximately 59,000 people are covered by the Product Members class.

According to the official website for the deal, LexisNexis FL settlement class members are eligible to receive a one-time, pro-rated cash payment from the settlement fund in an equal amount, regardless of which subclass they are covered by.
Importantly, consumers included in the Contact Members class do not need to do anything to receive their payout from the settlement fund, as their information is already processed within LexisNexis FL company systems. However, consumers covered by the Product Members class must submit a valid, timely claim form in order to receive compensation from the class action settlement.

Per the settlement site, eligible class members will receive settlement payouts of no less than $150, and potentially up to $1,000, depending on the number of valid Product Member claim forms that are submitted and what is left in the settlement fund after the payment of attorneys’ fees, service awards and settlement administration costs.
The settlement agreement outlines that all LexisNexis settlement class members have the option to receive their payout via check or electronic payment. Electronic settlement payments not accepted within seven days after issuance “will be cancelled and distributed by check,” court documents state, and any checks that go uncashed within 90 days or are returned undelivered will remain in the settlement fund.
Settlement money returned to the fund will be redistributed on a pro-rata basis to LexisNexis FL class members who cashed their initial settlement check, so long as the amount of the reimbursement would equal or exceed $25, court documents add.
To submit a LexisNexis settlement claim form online, Product Members can head to this page and enter the unique class member ID found on their copy of the Product Member-specific settlement notice. Consumers who believe they may be a class member but did not receive a settlement notice should contact the settlement administrator to confirm their identity and receive their login information.
Alternatively, consumers in the Product Members subclass may download a PDF of the claim form to print, fill out, and return by mail to the address listed near the bottom of the document.
LexisNexis Contact Members may also contact the settlement administrator to provide any address changes or requests for electronic payment in order to properly receive their payout.
All LexisNexis FL Product Member claim forms must be submitted online or by mail by May 15, 2026.
The court will determine whether to grant final approval to the LexisNexis settlement at a hearing on March 16, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The LexisNexis FL class action lawsuit claimed that the data analytics company, in violation of the federal Fair Credit Reporting Act, failed to accurately report that living consumers were still alive, and instead reflected that they were deceased on many of its internal products.
