$1.5M Money Source Settlement Ends Class Action Lawsuit Over Alleged Voice Messages

The Money Source (TMS) has agreed to a $1,500,000 settlement to end a class action lawsuit that alleged the mortgage lender and servicer unlawfully called cell phones using an artificial or prerecorded voice after consumers requested that the calls stop.

The Money Source class action settlement received preliminary approval from the court on June 25, 2026. The deal covers all individuals in the United States or its territories to whom The Money Source placed, or caused to be placed, a call directed to a number assigned to a cellular telephone service and that appears on the document produced at TMS005442, in connection with which TMS used an artificial or prerecorded voice after the called party requested that TMS stop placing telephone calls using an artificial or prerecorded voice to their cell phone, as recorded in TMS’s business records, from February 6, 2019 through May 7, 2025.

Settlement class members do not need to take action to automatically receive a pro rata cash payment.

The final amount of each class member’s cash payout will depend on, among other factors, the number of calls they received after requesting that The Money Source stop placing calls using an artificial or prerecorded voice to their cell phone.

Class members who wish to exclude themselves from the TMS settlement must mail a signed letter with the case name, their contact information, the cell phone number where they received a prerecorded voice call, and a request for exclusion to the settlement administrator.

All requests for exclusion must be postmarked by October 7, 2026.

The court will determine whether to grant final approval to The Money Source robocall settlement following a hearing on November 16, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.

The Money Source class action lawsuit alleged that the Arizona-based mortgage lending and loan servicing company violated the federal Telephone Consumer Protection Act by placing prerecorded and/or artificial voice calls to consumers who had already requested that the prerecorded or artificial voice calls from the company stop.
