$1.3M DAP Health Settlement Wraps Up Lawsuit Over 2024 Data Breach

DAP Health has agreed to a $1.3 million settlement to wrap up a class action lawsuit that alleged the community health center failed to adequately protect private information from unauthorized access during a July 2024 data breach.

The DAP Health class action settlement received preliminary approval from the court on June 8, 2026. Eligible to participate in the settlement are all individuals in the United States whose private information was compromised in the data breach, including all who received notice of the incident.

Court documents state that approximately 129,973 people are included in the settlement class.

Settlement class members who file a timely, valid claim form can receive up to $5,000 for documented out-of-pocket losses incurred due to the DAP Health data breach. This benefit covers losses from fraud or identity theft and costs for professional fees, postage, mileage, and more.

Class members must submit proof, such as bank statements or receipts, to receive a documented-loss payment.

In addition, all class members can submit a claim form to receive an estimated $25 cash payment, with no proof required.

The final amount of each class member’s cash payment may increase or decrease on a pro rata basis, depending on the total number of valid claims filed, among other factors.

Class members who were California residents on July 22, 2024 and were sent notice of the data breach can submit a claim form to receive an additional $75 cash payment.

Finally, all class members can elect on their claim form to receive two years of one-bureau credit monitoring, medical record monitoring, and identity theft insurance.

To submit a DAP Health settlement claim form online, class members can head to this page and enter the unique ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete, and return by mail to the settlement administrator.

All DAP Health settlement claim forms must be submitted online or postmarked by October 21, 2026.

The court will determine whether to grant final approval to the DAP Health settlement following a hearing on October 1, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.

The DAP Health class action lawsuit alleged that the California-based community health clinic failed to implement reasonable cybersecurity measures to protect private information from a data breach that occurred on July 22, 2024.

Per court documents, sensitive information that may have been compromised in the breach included names, Social Security numbers, addresses, dates of birth, phone numbers, driver’s license numbers, passport numbers, birth certificate numbers, vehicle license plate numbers, VINs, financial account numbers, Medicare/Medicaid numbers, health insurance plan and policy numbers, medical diagnoses, medical procedures and treatments, procedure/treatment dates and locations, treatment costs, laboratory test results and images, vital signs records, medical histories, allergies, prescription drugs taken, and medical provider names.
