Issue #353

Shipt Drivers Fight for Fair Pay and Benefits

We’re opening this issue with an investigation into whether Shipt drivers are being illegally misclassified as independent contractors—and therefore deprived of certain benefits—and how workers can take action. More on that below.

From there, two new class action lawsuits are taking issue, respectively, with a popular fitness company’s credit expiration policy and an airline’s subscription program.

Lastly, we’ll wrap up this issue with the latest in class action settlements, including one reached in litigation over a massive data breach announced in mid-2023. Keep reading for the details.

Shipt Drivers: Were You Paid Properly?

Attorneys believe Shipt may have violated labor laws by misclassifying drivers as independent contractors instead of employees, and they’re now gathering affected workers to take legal action. By classifying drivers as contractors, Shipt may be attempting to avoid providing benefits like minimum wages, overtime, expense reimbursement and workers’ compensation. Learn how drivers can take action here.

ClassPass 30-Day Credit Expiration Policy Sparks Lawsuit

The new proposed class action claims that the platform’s credit policy—which permits only a portion of a subscriber’s credits to roll over every 30 days and revokes remaining credits upon membership cancellation—violates two federal laws that prohibit the sale of prepaid gift cards or gift certificates with expiration periods of less than five years.
