Issue #345

Miscalculated Overtime and Online Privacy

We’re opening this issue with investigations into how certified nursing assistants are paid and how a certain consumer electronics retailer may be violating the privacy of California shoppers.

From there, attorneys are expanding their investigation into social casino apps and gambling websites. Last up, we’ll touch on a new lawsuit that takes issue with how a popular soda brand advertises certain drinks as “naturally” flavored.

Keep reading for the details, as well as the latest class action settlements that you may be able to claim.

CNAs: Were You Shorted on Overtime Pay?

Attorneys working with ClassAction.org believe some employers may be underpaying CNAs by failing to include shift differentials (i.e., extra pay for undesirable shifts) when determining their overtime rates. Workers who weren’t paid properly may be able to take action to recover wages that were earned but not paid. So, if you received shift differentials in your overtime weeks, learn more about how time-and-a-half rates should be calculated.

California BestBuy.com Shoppers: Was Your Privacy Violated?

Attorneys believe that BestBuy.com may be violating a California privacy law by requiring consumers to enter both their email address and phone number to complete a credit card purchase. Companies that break this law could owe consumers hundreds for violations. So, if you live in California and made a credit card purchase on BestBuy.com, learn more and join others taking action over on this page.

New Investigation: Nitrous Oxide Canister Lawsuits

Attorneys are ready to file lawsuits on behalf of individuals who suffered neurological, pulmonary and cardiac injuries from use of nitrous oxide canisters, also known as whippets. They suspect manufacturers and sellers are not properly warning of the risks, know the products are being misused and selling them anyway, and are intentionally targeting vulnerable populations, including youth. Coca-Cola Company Faces Lawsuit Over Sprite, Fanta Ingredients

A proposed class action accuses The Coca-Cola Company of falsely advertising that certain Sprite and Fanta beverages are made with “100% Natural Flavors.” This representation is misleading, the case says, because the sodas contain multiple synthetic ingredients that are “integral and indispensable” to the drinks’ flavors. Read more on the allegations here.
