WPM Pathology Lab, Salina Regional Health Center Settlement Resolves Lawsuit Over 2024 Data Breach

WPM Pathology Laboratory and Salina Regional Health Center, Inc. have agreed to a settlement to resolve a class action lawsuit that alleged the medical entities failed to safeguard private information on the lab’s systems from a November 2024 data breach.

The WPM Pathology Laboratory class action settlement received preliminary approval from the court on July 20, 2026. Eligible to participate in the settlement are all individuals whose private information was compromised in the data breach, including all to whom WPM Pathology sent an individual notice regarding the incident. 

Court documents state that approximately 5,619 people are covered by the settlement.

Settlement class members who submit a timely, valid claim form can receive up to $400 for documented “ordinary” losses incurred between November 4, 2024 and October 19, 2026 due to the data breach. This benefit covers costs for credit reports, credit monitoring, freezing or unfreezing credit, replacement IDs, postage, and more.

Additionally, class members can file a claim form to receive up to $4,000 for documented “extraordinary” losses incurred between November 4, 2024 and October 19, 2026 because of the WPM Pathology cyberattack. This benefit covers losses from identity theft or fraud that are not already covered by another settlement benefit.

Class members must submit proof, such as bank statements or receipts, to receive a documented-loss payment.

Further, class members can file a claim form to receive reimbursement for up to four hours of lost time spent responding to the data breach, at a rate of $20 per hour. This benefit covers time spent on activities such as changing passwords, investigating suspicious account activity, and researching the breach.

In lieu of any other cash payment, class members can instead submit a claim form to receive a $45 cash payout, with no proof required. 

Lastly, all class members can elect on their claim form to receive two years of CyEx Identity Defense Complete, which includes credit monitoring, dark web scanning, public records monitoring, and identity theft insurance.

To submit a WPM Pathology settlement claim form online, class members can head to this page and enter the login ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.

All WPM Pathology Laboratory settlement claim forms must be submitted online or postmarked by October 19, 2026.

The court will determine whether to grant final approval to the WPM Pathology settlement following a hearing on December 16, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.

The WPM Pathology Laboratory class action lawsuit alleged that the clinical laboratory based in Salina, Kansas, along with Salina Regional Health Center, failed to implement reasonable cybersecurity measures to protect sensitive information from a targeted cyberattack in November 2024.

Court documents state that private information that may have been accessed during the breach included dates of birth, Social Security numbers, diagnosis information, medical record numbers and health insurance claims information.
