WaterStreet settlement class members who file a timely, valid claim form can receive up to $3,000 for documented losses incurred between March 17, 2025 and August 19, 2026 due to the breach. This benefit covers losses arising from identity theft or fraud and the costs of credit reports, credit monitoring, freezing or unfreezing credit, replacement IDs, postage and more.
Class members must submit proof, such as bank statements or receipts, to receive a documented-loss payout.
In lieu of a documented-loss payment, class members can file a claim form to receive an approximately $55 cash payment with no proof required.
Should the value of all valid claims exceed $500,000, payments to class members may be subject to a pro rata (equal-share) reduction.
In addition to monetary relief, class members are eligible to enroll in three years of CyEx Financial Shield Complete, which includes one-bureau credit monitoring and financial fraud insurance. Per the settlement website, enrollment codes will be sent to class members via email or postcards.
To file a WaterStreet settlement claim form online, class members can head to this page and enter the login ID and PIN listed on their copy of the settlement notice. Alternatively, class members can download a PDF of the claim form to print, fill out and return by mail to the settlement administrator.
All WaterStreet settlement claim forms must be submitted online or by mail by August 19, 2026.
The court will determine whether to grant final approval to the WaterStreet Company settlement following a hearing on September 3, 2026. Compensation will begin to be distributed and credit monitoring can be activated only after final approval is granted and any appeals are resolved.
The WaterStreet Company class action lawsuit alleged the insurance software and services company failed to implement adequate cybersecurity measures to protect sensitive information in its care, which led to a data breach on or around March 17, 2025.
Per court documents, private information potentially exposed by the breach included names, taxpayer ID numbers, bank account information and Social Security numbers.
