$3.6M+ Anthem Settlement Ends Lawsuit Over Denial of Coverage for Proton Beam Cancer Treatments

Anthem Insurance Companies and Blue Cross Blue Shield Healthcare Plan of Georgia, Inc. have agreed to a more than $3.6 million settlement to resolve a class action lawsuit that alleged Anthem improperly denied health insurance coverage for proton beam radiation therapy (PBRT) for prostate cancer.

The $3,625,000 Anthem class action settlement received preliminary approval from the court on May 22, 2026. Eligible to take part in the settlement are all individuals identified by Anthem in discovery who received and sought coverage from Anthem for PBRT for prostate cancer, but whose treatments were not covered by insurance (by Anthem or otherwise).

Anthem settlement class members who file a timely, valid claim form with proof that they made qualifying out-of-pocket payments for PBRT for the treatment of prostate cancer can receive a cash payment based on the total amount of qualifying payments they made.

Proof of qualifying cash payments must include the provider’s name, provider’s address, date of service, description of services provided, and provider charges for which the class member paid out-of-pocket.

To submit an Anthem settlement claim form, class members can head to this page and download a PDF claim form to print, complete, and return by mail to the settlement administrator.

All Anthem proton beam settlement claim forms must be submitted by October 10, 2026.

The court will determine whether to grant final approval to the Anthem settlement following a hearing on August 19, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.

The Anthem class action lawsuit alleged that the insurer improperly denied health insurance coverage for PBRT, used for the treatment of prostate cancer, under the Employee Retirement Income Security Act of 1974 (ERISA) for individuals who were beneficiaries of an ERISA-regulated health plan.
