Susan B. Allen Memorial Hospital Settlement Resolves Data Breach Lawsuit

Susan B. Allen Memorial Hospital has agreed to a class action settlement to resolve litigation that alleged the nonprofit facility failed to adequately safeguard sensitive information from a July 2025 data breach.

The Susan B. Allen Memorial Hospital class action settlement received preliminary court approval on June 1, 2026. Eligible to participate in the settlement are all individuals who were sent written notification of the data breach.

Court documents state that approximately 12,433 people are covered by the settlement.

The court-approved website for the Susan B. Allen Memorial Hospital (SBAMH) class action settlement can be found at SBAMHDataSettlement.com.

Settlement class members who file a timely, valid claim form can receive up to $100 for documented out-of-pocket losses incurred between July 14, 2025 and November 12, 2026 because of the SBAMH data breach. This benefit covers losses from identity theft or fraud and costs for credit reports, credit monitoring, replacement IDs, postage, and more.

Class members must submit proof, such as bank statements or receipts, to receive a documented-loss payment.

In addition, all class members can file a claim to receive reimbursement for up to four hours of lost time spent dealing with the breach, at a rate of $25 per hour. This benefit covers time spent changing passwords, investigating suspicious account activity, and researching the data breach.

Payments to class members for out-of-pocket losses and attested time are subject to a combined $100 aggregate cap per person.

Lastly, all class members can elect on their claim form to receive two years of CyEx Medical Shield Complete, which includes medical identity theft insurance.

To submit a Susan B. Allen Memorial Hospital settlement claim form online, class members can head to this page and enter the login ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.

All Susan B. Allen Memorial Hospital settlement claim forms must be submitted online or postmarked by November 12, 2026.

The court will determine whether to grant final approval to the SBAMH data breach settlement following a hearing on December 7, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.

The Susan B. Allen Memorial Hospital class action lawsuit alleged that the El Dorado, Kansas-based nonprofit hospital failed to implement reasonable cybersecurity measures to safeguard private information from a data breach in July 2025.

Per court documents, confidential information that may have been compromised in the breach included names, dates of birth, health insurance information, billing information and medical treatment information.
