The 23-page false advertising lawsuit states that on January 12, 2026, Spring & Mulberry issued a voluntary recall of its “Mint Leaf” flavor of date-sweetened chocolate bars, citing concerns over potential salmonella contamination. The recall was expanded on January 14, 2026 to include the following product flavors and lot codes:
- -Mint Leaf with lot code #025255
- -Earl Grey with lot code #025258;
- -Lavender Rose with lot codes #025259 and #025260;
- -Mango Chili with lot code #025283;
- -Mixed Berry with lot codes #025275, #025281 and #025337;
- -Mulberry Fennel with lot code #025345;
- -Pecan Date with lot codes #025261, #025265, #025267, #025268, #025339 and #025343; and
- -Pure Dark Minis with lot code #025273.
The lawsuit claims that Spring & Mulberry did not “truthfully and honestly report” that the products were potentially adulterated with salmonella. Instead, the lawsuit says, the company made repeated assertions on its chocolate bars packaging that they are “ridiculously good for you” and made with “fantastic-for-you ingredients.” Additionally, the packaging included statements that the chocolate bars are “organic” and made with “clean ingredients” that are “simply better for you,” the case relays.
According to the lawsuit, Spring & Mulberry made these misrepresentations to capitalize on consumers’ rapidly growing demand for “clean” and healthy products, because consumers are willing to pay a price premium for products they perceive as being healthy.
Consumers, the case states, have no way to ascertain that a product they are purchasing is safe for consumption beyond its packaging and labeling. Because Spring & Mulberry is in the “unique position” to know the ingredients and manufacturing process for its chocolate bars, and the risks of salmonella contamination, the company had a duty to provide consumers accurate information about the contents of its products, the suit argues.
According to the filing, salmonella can cause serious infections or even death in young children, the elderly and immunocompromised individuals and, in some cases, can even cause severe illness in healthy individuals if it enters the bloodstream. The case states that salmonella is the “leading cause” of foodborne illness, hospitalizations and deaths both in the United States and worldwide.
Because of the serious risks associated with salmonella, the affected Spring & Mulberry chocolate bars are unfit for human consumption, the lawsuit states, claiming consumers purchased products that were “mislabeled, unhealthy, and entirely worthless.”
The Spring & Mulberry class action lawsuit seeks to cover all individuals in the United States who purchased the chocolate manufacturer’s affected products.
