According to the settlement agreement, class members who file a timely, valid claim form with proof of purchase will be eligible to receive the full purchase price for each unit they bought of a qualifying product, including taxes.
Per the agreement, consumers who submit a claim form without proof of purchase will be eligible to receive the average retail price for up to two covered products per household, plus a 10-percent allowance for sales tax.
The Quaker Oats settlement website says that if a class member or someone in their household previously received reimbursement from the recall, their settlement payout will be reduced by the amount they have already received.
All Quaker settlement payments are subject to adjustment on a pro rata basis so as to exhaust the $6,750,000 settlement fund, the site adds.
The deal with the Quaker Oats Company was preliminarily approved by the court on March 13, 2025. It is now up to the court to determine whether to grant final approval to the terms of the settlement at a hearing on August 4, 2025.
Should the deal receive ultimate court approval, cash benefits will be issued to eligible class members within 60 days following the date it goes into effect, the settlement agreement shares.
The United States Food and Drug Administration announced on December 15, 2023 that Quaker had initiated a recall of certain granola bars and cereals due to potential salmonella contamination. The recall was expanded on January 11, 2024 to include additional cereals, granola bars and snacks.
The Quaker class action lawsuit contended that the company failed to warn consumers that the products risked containing salmonella, a potentially life-threatening bacterium. As such, shoppers were misled into believing the items were safe to consume and posed no hazards to their health, the suit alleged.
