The QPharma class action settlement received preliminary approval from the court on March 9, 2026. The deal covers all United States residents whose personal information was potentially compromised in the data incident that affected QPharma in December 2024, including anyone who received notice of the data breach.
According to court documents, approximately 937 individuals are covered by the QPharma data breach settlement.
The court-approved website for the QPharma data breach settlement can be found at QPharmaDataIncident.com.
According to the website, class members who submit a timely, valid claim form can receive up to $750 for “ordinary” out-of-pocket losses stemming from the data breach. This benefit covers expenses related to fees for credit reports, credit monitoring, or freezing or unfreezing credit; ID replacement costs; and postage to contact banks by mail.
The agreement states that class members must submit reasonable third-party documentation, such as receipts, to receive this payment.
Class members may also submit a claim form to receive reimbursement for up to four hours of lost time spent dealing with the data breach, at a rate of $20 per hour. This settlement benefit is subject to the $750 ordinary-loss cap, the website says.
Additionally, class members can file a claim to receive up to $5,000 for “extraordinary” losses, such as identity theft or fraud, incurred because of the breach. To obtain this benefit, class members must also submit documentation.
Class members may also submit a claim form to receive two free years of CyEx Financial Shield Complete, which includes financial fraud insurance and monitoring.
In lieu of any other settlement benefits, class members may instead submit a claim form to receive an alternative cash payment of $50. No proof is required to obtain an alternative cash payout.
To submit a QPharma settlement claim form online, class members can head to this page and enter the unique ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, fill out and return by mail to the settlement administrator.
All QPharma data breach settlement claim forms must be submitted online or postmarked no later than July 7, 2026.
Finally, per the agreement, QPharma has agreed to implement cybersecurity enhancements to mitigate the risk of a future data breach.
The court will determine whether to grant the QPharma settlement final approval following a hearing on July 13, 2026. Compensation will be distributed to class members only after final approval has been granted and any appeals have been resolved.
The QPharma class action lawsuit alleged that the software company failed to implement reasonable cybersecurity measures to prevent a targeted cyberattack in December 2024, during which cybercriminals accessed personally identifiable information.
