Pediatric Home Services Settlement Ends Litigation Over November 2024 Data Breach

Pediatric Home Services has agreed to offer cash and credit monitoring to settle a class action lawsuit over a November 2024 data breach.

Pediatric Home Respiratory Services has agreed to a settle a class action lawsuit that alleged the Minnesota-based medical provider, operating as Pediatric Home Services, failed to protect the sensitive information stored on its systems from a targeted cyberattack in November 2024.

The Pediatric Home Respiratory Services settlement received preliminary court approval on January 6, 2026 and covers all individuals in the United States who were received notice from the pediatric healthcare provider that their private information was impacted in the November 2024 data breach.
Court documents state that approximately 43,634 individuals’ information may have been compromised by the breach.
The court-approved website for the Pediatric Home Services (PHS) settlement can be found at PHSDataSettlement.com.
According to the website, PHS settlement class members who submit a timely, valid claim form have multiple options for reimbursement. Class members who submit their claim form with proof of documented out-of-pocket losses incurred due to the data breach are eligible to receive up to $1,500 in reimbursement, called “Cash Payment A” on all court documents.
The agreement states that reimbursable expenses must have been incurred between November 1, 2024 and April 23, 2026 and include those related to identity theft or fraud, credit monitoring, freezing or unfreezing credit, costs to replace IDs and postage.
In place of a documented-loss payment, PHS class members may instead file a claim form to receive an alternative one-time cash payment of $50, also called “Cash Payment B.” No proof or explanation is needed from class members to claim this payment.
In addition to monetary benefits, the agreement offers all class members one free year of CyEx credit monitoring, which will be issued as an enrollment code via email. The settlement site relays that class members may choose between Medical Shield Complete, CyEx Identity Defense Total, or CyEx Minor Defense Pro, each of which includes identity theft insurance and access to fraud resolution agents.
The settlement site notes that each credit monitoring service focuses on a different area of concern; class members primarily concerned with misuse of their healthcare information may elect to enroll in CyEx Medical Shield Complete, while those more concerned about general identity theft can opt for CyEx Identity Defense Total. Additionally, the site states that class members who are minors may enroll in CyEx Minor Defense Pro.
To submit a Pediatric Home Services claim form online, class members—including parents and guardians of minor class members—can head to this page and enter the unique ID and PIN from their received copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, fill out and return by mail to the settlement administrator.
All Pediatric Home Services settlement claim forms must be submitted online or postmarked no later than April 23, 2026.
The court will determine whether to grant the PHS settlement final approval at a hearing on May 8, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Pediatric Home Respiratory Services class action lawsuit alleged that the Minnesota-based pediatric respiratory specialist failed to protect the confidential patient information stored on its systems, leading to a data breach that occurred approximately between November 1, 2024 and November 7, 2024. According to court documents, the private information that was potentially impacted by the breach included names, addresses, Social Security numbers, medical information, and health insurance information.
